1. introduction

these terms and conditions (terms) apply when you access or use www.hardlysolo.com and any related webpage, booking interface or online feature operated by us (website).

the website is operated by Hardly Solo Pty Ltd ABN 81 699 649 904 (Hardly Solo, we, us or our). by using the website, you agree to these terms. if you do not agree, you must not use the website.

these terms govern use of the website only. a booking or participation in a tour is also governed by the tour service agreement, participant liability waiver, code of conduct and any itinerary or booking particulars accepted for that booking (tour documents). if these terms conflict with a tour document about a booking or tour, the tour document prevails to the extent of the conflict.

we may update these terms for future website use by publishing a revised version. an update does not retrospectively change an existing booking contract unless permitted by the applicable tour documents or law.

2. website information and tour enquiries

website information is general and may change. tour dates, prices, routes, accommodation, transport, meals, activities, inclusions, exclusions, availability and minimum numbers are subject to the applicable itinerary, booking process and tour service agreement.

displaying a tour, price or place on the website is not a guarantee of availability and is not, by itself, acceptance of a booking. a booking is formed only as stated in the tour service agreement and booking confirmation.

images, maps, travel times and descriptions are illustrative. conditions in Sri Lanka and other destinations may change because of weather, traffic, supplier operations, local requirements, safety considerations or events outside our control.

do not make non-refundable flights or other independent travel arrangements until Hardly Solo has confirmed that the relevant trip will proceed. the treatment of independently purchased arrangements is set out in the tour service agreement.

3. access and acceptable use

you may use the website for lawful personal purposes, including learning about Hardly Solo, making an enquiry and starting or managing a booking. if you use the website for another person, you must be authorised to do so and must provide accurate information.

you must not:

  1. use the website unlawfully, fraudulently, deceptively or in a way that infringes another person's rights;
  2. submit false booking, identity, payment, insurance, health or contact information;
  3. interfere with the website, its hosting, security, booking or payment functions, or another user's access;
  4. introduce malicious code, probe for vulnerabilities, gain unauthorised access, scrape or harvest data, or use automated tools in a way that burdens or circumvents the website;
  5. impersonate another person or use another person's payment method or account without authority;
  6. copy, frame, mirror, republish, commercialise or create derivative works from website content except as permitted by law or with our written consent; or
  7. use the website or website content to mislead others about an association with or endorsement by Hardly Solo.

4. enquiries, accounts and submissions

you are responsible for information submitted through the website and for keeping any login, booking reference or access link secure. tell us promptly if you suspect unauthorised access.

an enquiry, waitlist request, newsletter subscription or incomplete checkout does not reserve a place. we may contact you to clarify information, prevent fraud, assess eligibility or complete a booking.

if you send us a review, testimonial, suggestion or other material, you confirm that you have the right to provide it. unless separately agreed, you give us a non-exclusive, worldwide, royalty-free licence to reproduce and communicate that material for operating and promoting Hardly Solo, subject to applicable privacy law. the separate media provisions in the tour service agreement apply to trip photographs, video and audio.

5. payments and third-party services

website payments are processed through Stripe or another disclosed payment provider. payment providers may apply their own terms and privacy notices. we generally do not receive or store complete card details.

the website may link to or integrate maps, videos, social media, accommodation, activity, insurance, government, payment or other third-party services. we do not control those services. a link or integration does not necessarily mean we endorse all third-party content, and your use of a third-party service may be governed by its own terms.

6. intellectual property

the website and its text, branding, logos, graphics, design, photographs, video, audio, itineraries, downloads and software (website content) are owned by or licensed to Hardly Solo and are protected by intellectual property laws.

we give you a limited, revocable, non-transferable licence to view and use website content for your personal evaluation or management of a Hardly Solo booking. no other right is granted. you must retain copyright and trade mark notices.

7. privacy and cookies

our privacy policy explains how we handle personal information. our cookies policy explains the cookies and similar technologies used on the website and the choices available to you. those policies form part of the information provided to website users but do not reduce any mandatory privacy right.

8. availability and security

we use reasonable care in operating the website but do not promise uninterrupted, error-free or completely secure access. we may suspend, restrict or change a website feature for maintenance, security, legal, supplier or operational reasons.

internet communications may be delayed, intercepted or corrupted. use current security software, verify payment pages and contact us through independently verified details if a message or payment request appears suspicious.

9. consumer rights and liability

nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

subject to those mandatory rights, we are not responsible for loss caused by your device, network, unauthorised use of your credentials, a third-party website or service, or reliance on website information after it has been superseded or where the need to verify it was reasonably apparent.

to the extent liability arising solely from use of the website can lawfully be limited, our liability is limited, at our option, to resupplying the relevant website service or paying the reasonable cost of having it supplied again. liability connected with a booking, trip or recreational services is governed by the applicable tour documents and mandatory law.

10. general

governing law

these terms are governed by the laws of New South Wales, Australia. you and Hardly Solo submit to the non-exclusive jurisdiction of its courts and tribunals, subject to any mandatory law that permits proceedings elsewhere.

severance and waiver

an invalid or unenforceable term is read down or severed to the minimum extent necessary. a delay or failure to exercise a right is not a waiver.
